8. Deposits

If tiles, glue, grout, trims, waterproofing products or other materials are supplied by the client, builder or third party, Top 10 Tiling is not responsible for defects in those materials.

  • Incorrect quantities
  • Delayed delivery
  • Wrong materials supplied
  • Manufacturing defects
  • Unsuitable products

Top 10 Tiling may refuse to install unsuitable or unsafe materials.

11. Site Access & Site Conditions

The client, builder or site manager must provide safe and reasonable access to the work area.

Required site conditions may include:

  • Safe access to the property
  • Power and water available
  • Clear working area
  • Suitable storage for tools and materials
  • Reasonable parking or unloading access
  • Surfaces ready for tiling
  • Other trades coordinated properly

Delays caused by restricted access, unsafe conditions, other trades, incomplete preparation or site issues may result in additional costs or delays.

12. Surface Preparation

Proper surface preparation is important for tiling quality and durability.

Additional preparation may be required where surfaces are uneven, damaged, moving, wet, contaminated, unsuitable or not ready for tile installation.

Unless specifically included in the quote, additional preparation may incur extra charges.

13. Waterproofing

Waterproofing only applies where it is specifically included in the agreed scope of works.

Where waterproofing is included, Top 10 Tiling aims to complete waterproofing in accordance with applicable Australian Standards and manufacturer requirements where relevant.

Top 10 Tiling is not responsible for failures caused by structural movement, plumbing defects, building defects, pre-existing leaks, works by other trades or waterproofing completed by third parties.

14. Tile Installation Tolerances

Tile installation may be affected by tile type, tile size, surface conditions, structural movement, tile manufacturing tolerances and layout requirements.

Natural stone, textured tiles and large format tiles may have natural or manufacturing variation.

Minor grout variation, shade variation, texture variation and acceptable industry tolerances may occur.

15. Completion Timeframes

Completion dates are estimates unless otherwise agreed in writing.

Project timeframes may be affected by:

  • Weather conditions
  • Material delays
  • Tile size or design changes
  • Additional works
  • Other trades
  • Restricted site access
  • Payment delays
  • Unforeseen site conditions

Top 10 Tiling is not responsible for delays outside its reasonable control.

16. Defects & Rectification

Any alleged defect must be reported in writing as soon as possible after it is identified.

Top 10 Tiling must be given a reasonable opportunity to inspect and rectify any genuine workmanship defect before the client engages another contractor, withholds payment, claims damages or commences legal action.

Top 10 Tiling is not responsible for defects caused by:

  • Other trades
  • Client supplied materials
  • Structural movement
  • Substrate failure
  • Plumbing issues
  • Building defects
  • Misuse or lack of maintenance
  • Impact damage after completion
  • Normal wear and tear

17. Warranties

Top 10 Tiling provides workmanship warranties only for works directly completed by Top 10 Tiling, subject to applicable laws and project terms.

NSW statutory warranties may apply to residential building work where required by the Home Building Act 1989 (NSW).

Warranty does not apply to damage caused by third parties, client supplied materials, structural movement, poor maintenance, misuse, unauthorised repairs or events outside the contractor’s control.

18. Cleaning & Handover

Top 10 Tiling will carry out reasonable tiling-related clean-up after works are completed.

Builder’s cleaning, deep cleaning, dust removal from other trades or professional cleaning services are excluded unless agreed in writing.

Final handover occurs when works are completed according to the agreed scope and final payment is made.

19. Photos, Videos & Marketing

Top 10 Tiling may take photos or videos of works for project records, quality control, evidence, portfolio, website, social media and marketing purposes.

Clients may request in writing that identifying personal information or private details are not shown in marketing material.

20. Workplace Health & Safety

Top 10 Tiling aims to work in accordance with applicable Work Health and Safety requirements.

Top 10 Tiling may stop or suspend works if unsafe conditions exist, including unsafe access, exposed electrical hazards, dangerous site conditions, aggressive behaviour or other serious risks.

21. Limitation of Liability

To the maximum extent permitted by law, Top 10 Tiling is not liable for indirect, consequential, financial, third-party or non-workmanship related losses.

Liability is limited to the rectification of proven workmanship defects directly caused by Top 10 Tiling, subject to applicable laws.

22. Suspension of Works

Top 10 Tiling may suspend works where:

  • Payments are overdue
  • Site access is restricted
  • Unsafe conditions exist
  • Materials are unavailable
  • Instructions are repeatedly changed
  • Abusive or aggressive conduct occurs
  • Other trades prevent work from continuing

Any resulting delay or additional cost may be the responsibility of the client, builder or responsible party.

23. Cancellation

If a project is cancelled after booking, preparation, ordering or commencement, the client may be responsible for costs already incurred.

This may include labour, administration, ordered materials, booking costs, travel, preparation and completed works.

24. Debt Recovery

If invoices remain unpaid, Top 10 Tiling may take reasonable steps to recover outstanding amounts.

Recovery action may include reminders, debt collection, legal proceedings and recovery of reasonable costs where permitted by law.

25. Disputes

If a dispute arises, both parties should first attempt to resolve the matter through professional communication and good faith negotiation.

Where required, disputes may be referred to NSW Fair Trading, mediation, tribunal or court.
